Tax Lien Notices Lawyer in Petaluma

An IRS Filing of Federal Tax Lien brings stress, worry and uncertainty. It serves as a public notice to creditors that the IRS has claim on your house, car, bank account and anything in your name against all your property, including property you acquire after the IRS files the lien. If you're in such a situation, consulting a Bankruptcy Attorney can help you understand your options and how to protect your assets.

An IRS lien is about the worst blemish that you can have on your credit report. A lien may affect your ability to buy a home, get a loan, a vehicle, a new credit card, or sign a lease. The ability to work or enjoy your personal life is severely impacted. Empower yourself with knowledge about the options you have with one telephone call to my law firm.

The government will withdraw a tax lien if it is determined that;

  • The notice was filed too soon or not according to IRS procedures

  • Withdrawal will allow you to pay your taxes more quickly, or

  • Withdrawal would be in your best interest (as determined by the National Taxpayer Advocate) and the best interest of the Government.

I'm attorney Andrew Kern, a member of the National Association of Consumer Bankruptcy Attorneys (NACBA), and I help people understand the bankruptcy process, specifically the effects on a tax lien. If you receive a Notice of Federal Tax Lien you need to contact me ASAP to determine how best to deal with it. You have the right to a Collection of Due Process hearing to challenge the Notice within 5 days of receiving such notice. If you cannot remove the tax lien or challenge it then you must deal with it ASAP by either paying off the tax debt, imposing a payment plan on the government through a Chapter 13, or trying an offer in compromise. An offer in compromise is not nearly as easy as those commercials on television would lead you to believe and is a process that takes many months.

A tax levy, which is different from a tax lien, is a legal seizure of your personal property to satisfy your tax debt. The levy enables the government to either seize and sell your possessions held by you or someone else, garnish your wages and/or empty your bank account to satisfy your back taxes. The government will levy when the following occurs:

  • The IRS has assessed the tax and sent you a Notice and Demand for Payment

  • You neglected or refused to pay the assessed tax

  • The IRS send a final notice of intent to levy and notice of your right to a hearing at least 30 days prior to the levy.

You can challenge a levy notice through a Collection Due Process Hearing provided the request is made within 30 days of the Notice. A bankruptcy filing stops all levies while providing time to assess your options.

If you receive a notice of Federal Tax lien or Final Notice of Intent to Levy then you need to contact me ASAP so we can do damage control before a lien is filed or a levy garnishes your wages, drains your bank account, or the government seizes your possessions. If you don't know how to negotiate your tax debt with the government then I can help you.

Tax issues are usually difficult and stressful. I'm here to help you, not judge you. I am here to identify the best solution. Chapter 7 or Chapter 13 bankruptcy may be the best chance you have in securing an automatic stay a possible tax lien or levy to stop further collection action.
