Credit card debt is not dischargeable when the card application was fraudulent or the card was used without any intention of paying. If that's the case then the card issuer may allege fraud by filing an adversary proceeding alleging that the debt be excluded from discharge. Other circumstances can prevent discharge of credit card debt, including:

• Newly issued cards

• Credit increases and/or cash advances right before filing

• Excessively large balances at the time of filing

• Purchasing luxury items 90 days prior to filing

• Exceeding credit limits

• Borrowing on one card to pay another

• Any charges made after a consultation with an attorney

• Using a credit card to take a vacation close to your filing date
